Information about Withdrawal
Right of withdrawal
You have the right to withdraw from this agreement within 30 days without giving any reason.
The withdrawal period is 30 days from the date:
-
on which you, or a third party designated by you (other than the carrier), take possession of the goods, if you have ordered one or multiple goods under one order and they were delivered simultaneously;
-
on which you, or a third party designated by you (other than the carrier), take possession of the last goods, if you have ordered multiple goods under one order and they were delivered separately.
To exercise your right of withdrawal, you must notify us of your decision to withdraw from this agreement. This can be done by email: Support@libertéwear.com.
You may use the attached model withdrawal form, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your communication regarding your exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this agreement, we will reimburse all payments received from you, including delivery costs (except for additional costs resulting from your choice of a different type of delivery than the standard delivery offered by us), immediately and no later than 30 days after receiving your withdrawal notice.
We will use the same payment method for this reimbursement that you used for the original transaction, unless expressly agreed otherwise. Under no circumstances will you be charged fees as a result of this reimbursement.
We may withhold reimbursement until we have received the returned goods or you have demonstrated that you have sent back the goods, whichever occurs first.
You must return or hand over the goods to us immediately and in any event no later than 30 days from the day on which you inform us of the withdrawal from the contract. The deadline is met if you send back the goods before the period of 30 days has expired.
The direct costs of returning the goods are your responsibility.
You are only guilty for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Reasons for exclusion and expiration of the right of withdrawal
The right of withdrawal does not apply to contracts:
-
for the delivery of goods that are not prefabricated and are made based on an individual choice or decision of the consumer;
-
for the delivery of goods that can quickly deteriorate or have a limited shelf life;
-
for the delivery of alcoholic beverages whose price was agreed upon in the contract but which can only be delivered at the earliest 30 days after the conclusion of the contract and whose value depends on market fluctuations;
-
for the delivery of newspapers, magazines, or periodicals, except for subscriptions.
The right of withdrawal expires prematurely for contracts:
-
for the delivery of sealed goods which are not suitable for return due to health protection or hygiene reasons if the seal has been broken after delivery;
-
for the delivery of goods which are inseparably mixed with other items after delivery due to their nature;
-
for the delivery of audio or video recordings or computer software in a sealed package if the seal has been broken after delivery.
